By downloading our app, using them or our services, you accept and agree to these Terms and Conditions (“Terms”). Therefore, it is important that you carefully read through these Terms. If you do not consent to these Terms, you should not use our product or register with StartFit.
To use our Services, you must follow some simple rules. The Service is only available for your private use and is not intended for commercial use. Do not misuse the Services, so that either StartFit or anyone else is harmed in any way. You may only use the Services as permitted by law and these Terms.
StartFit is committed to ensuring that the apps are as useful and efficient as possible. For that reason, we reserve the right to make changes to the apps or to charge for its services, at any time and for any reason. We will never charge you for the apps or its services without making it very clear to you exactly what you’re paying for.
Our apps might store and processes personal data that you have provided to us, in order to provide our Service, depending from the features you are using in the apps. It’s your responsibility to keep your phone and access to the apps secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that our apps won’t work properly or at all.
You’re not allowed to copy, or modify the apps, any part of the apps, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the apps into other languages, or make derivative versions. The apps itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to StartFit.
By submitting User Material to StartFit, you warrant and represent that you hold the copyright, trademark and/or other intellectual property rights to your content. You agree to grant StartFit a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use User Material to the extent necessary for StartFit to operate and maintain the Service. This license shall remain valid until the respective User Material is deleted from the Service by you or by StartFit in accordance with these Terms.
You use our services and apps at your own risk. They are provided “AS IS,” without any warranties, and StartFit does not warrant that the service and availability thereof will be uninterrupted or error-free.
You should be aware that there are certain things that StartFit will not take responsibility for. Certain functions of the apps will require the apps to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but StartFit cannot take responsibility for the apps not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the apps outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the apps, or other third party charges. In using the apps, you’re accepting responsibility for any such charges, including roaming data charges if you use the apps outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the apps, please be aware that we assume that you have received permission from the bill payer for using the apps.
Along the same lines, StartFit cannot always take responsibility for the way you use the apps i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, StartFit cannot accept responsibility.
With respect to StartFit’s responsibility for your use of the apps, when you’re using the apps, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. StartFit accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the apps.
At some point, we may wish to update the apps. The apps are currently available on Android and iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the apps to) may change, and you’ll need to download the updates if you want to keep using the apps. StartFit does not promise that it will always update the apps so that it is relevant to you and/or works with the iOS/Android version that you have installed on your device. However, you promise to always accept updates to the applications when offered to you, We may also wish to stop providing the apps, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the apps, and (if needed) delete it from your device.
For the apps where an account is needed, you can choose to cancel/end your account anytime. If you have a subscription running, then be aware that uninstalling the mobile application or closing your account will not automatically stop your subscription — you must actively cancel the subscription. Please note that if you have subscribed to StartFit through the use of App Store, Google Play Store or any other such service provider, you can only cancel your subscription through the use of their services. To find out how to cancel the subscription and/or your account, please follow the instructions in the app or on the website.
You are responsible for your own health. StartFit is not a medical organization and we will not provide you with any medical advice or diagnosis. The purpose of the Services is solely to help our users to record what they eat, how they exercise and to track their health, weight and fitness progress. Information made available through the Services and by our partners and affiliates shall solely be used for recreational and educational purposes.
Always consult with your doctor before starting a diet or fitness program or if you experience any pain or discomfort. Please do not use our Services if you suffer from, or might suffer from, any medical condition that may be impaired by diet or exercise. StartFit cannot guarantee that the nutritional information provided in our database is accurate, reliant or complete. StartFit is not responsible for any personal injury or any other damages that may have been the result, direct or indirect, of any use or misuse of the Services.
This section only applies when you purchase and/or subscribe to StartFit Premium or other paid products. By paying the subscription fee, you get access to StartFit Premium during the time your subscription is valid, subject to these Terms.
All subscriptions with StartFit Premium are paid in advance.
You may at any time terminate your membership, in which case your membership will still be valid for the subscription time you have already paid for. If you have subscribed to StartFit through the use of App Store, Google Play Store or any other such service provider, using in-app purchase, you can only cancel your subscription through the use of their services. Subscription fees can be found in the mobile application. StartFit reserves the right to change the subscription fees from time to time.
These Terms and the use of the Services are governed by the laws of Ecuador, except for its conflicts of laws principles. All claims arising out of or relating to these Terms or the Service shall be resolved by Ecuador public courts.
